defendants who owe billions in damages. Ten years of fraud, deceit and
public
corruption in healthcare is coming to an end.
Citizens, employers and the states of Missouri and Kansas
have been
injured by
the defendantsı Novation LLC cartelıs conduct to
artificially
inflate
hospital supply costs. The injuries have included the loss of
healthcare
insurance, a resulting loss of life from decreased medical
care,
and loss of life from shortages of supplies at Missouri hospitals
like
Truman Medical Center that were not controlling members of the
Novation
LLC cartel.
The states have lost manufacturing jobs and their auto
plants have been
shut
down because the artificial inflation of hospital supply costs has
made
healthcare in Missouri and Kansas an uncompetitive input resulting in
foreign
manufacturers gaining market share previously controlled by
Missouri and Kansas businesses.
The states of Missouri and Kansas have been injured from
the overcharging
by the defendantsı Novation LLC cartel, the artificial inflationıs
impediment to
Missouri and Kansasıs duty of providing healthcare to
socially and
economically disadvantaged citizens; and the loss of tax
revenue
from the jobs killed by uncompetitive employee healthcare costs
caused by
the defendantsıNovation LLC cartelı hospital skimming.
During the period addressed by this litigation the
Missouri hospitals did not
report
their rebates in their Medicare reimbursement claims through the
corruption of
the Medicare administrator Blue Cross Blue Shield of Kansas
(³BCBSK²). But, because of this misconduct, BCBSK lost
the bid to renew
the Medicare
administration contract. Topeka lost over 350 above living
wage
jobs less than a mile away from the Kansas State House.
The Missouri hospitals that were controlling members of
the Novation LLC
cartel
attempted to violate state antitrust laws by replacing the corrupt
preferential
treatment in Medicare claims reimbursement for hospital
supplies and
tried to further the Novation LLC monopoly through a
failed
state
scheme to administer Medicaid funds and purchase hospital supplies
called
³Insure-Missouri².
